The decision will mark the end of a six-year legal battle that has huge ramifications for thousands of customers, with the lawyers suing ANZ also after Westpac and Commonwealth banks.
Australia's highest court will today decide if ANZ's charge of $35 for late credit card payments is unlawful and could hand down peanlties and decide if customers will be reimbursed.
A favourable ruling will represent a huge win for consumers but a win for ANZ will lead to tightened consumer protection laws.
The law firm Maurice Blackburn brought forward cases of 43,500 ANZ customers claiming there is $57million being overcharged.
Maurice Blackburn has already settled a case with NAB, where $6.6million was handed back to customers.
