A 42-year-old Belconnen man has been issued a formal caution after Police discovered four cannabis plants, weighing approximately 91kgs, growing on his balcony.

Police seized and destroyed the plants as the man was found to have exceeded the Territory’s current possession limit of two plants per person.

In a statement, ACT Police has reminded Canberrans to familiarise themselves with the Territory’s legal limits.

“Under ACT law one person cannot be responsible for cultivating more than two plants (regardless of how many people live at the address).”

“While the man lived with a housemate, he was the only resident cultivating the plants. This is considered a breach of Section 618(2)(a) of the Criminal Code 2002 (ACT) which states that it is an offence if a person cultivates three or more cannabis plants.”

Under the current laws, if there are more than two plants at a property, they must be being cultivated by at least two residents.
